The appellees are the heirs of John Buckley and wife, both of whom died many years ago. They instituted this suit against the appellant to recover a tract of 646 acres of land situated in Shelby county, and patented by virtue of an unlocated balance of a certificate, the original of which was issued to John Buckley in 1888. A portion of the certificate was located and patent issued to him in 1847. A certificate for the unlocated balance was not issued during his lifetime, but was sold by one J. L.
