In this appeal from a judgment of the Circuit Court of St. Louis County, the appellants, (plaintiffs in the trial court) Donald Dubail, Phillip Newmark and Ned English, as the Trustees of Ladue Trail Subdivision, instituted this cause of action for the purpose of obtaining an injunction restraining the respondent, Green Trails Plaza, Inc.,1 from constructing a proposed medical office complex on Lot 7, Plat 2 of the subdivision.2 The respondent filed a counterclaim for declaratory judgment adjudicating the respective rights and duties of the parties under the terms of a…
