The appellant, F. R. Atkins, instituted an action in his own behalf as a citizen and taxpayer of Monroe County, and in behalf of all other owners of taxable property in that county, and for the use and benefit of said county, against the appellee, W. L. Graham, as former treasurer of said county, and the sureties upon his official bond, to recover certain school funds which it was alleged that the county court had ordered to be turned over to his successor in office.
