This is an appeal from an order granting the defendant’s motion for nonsuit, and also from an order denying plaintiff’s motion for a new trial.

The action is one to recover upon a promissory note executed by the defendant to F. P. Cutting Company, a corporation, payable one day after date, which said note the plaintiff alleged was indorsed and assigned to Gerald C. Halsey, and by said Halsey to the plaintiff.
