Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner, an inmate at Great Meadow Correctional Facility in Washington County, was charged in a misbehavior report with Penal Law offenses, conspiring to escape and smuggling, after being implicated as a participant in a plan to escape from the facility. Following a disciplinary hearing, petitioner was found guilty of conspiring to escape and smuggling.…
