This is an appeal from a judgment affirming an annexation ordinance passed and adopted by the Common Council of the City of Jasper, Indiana. Appellant Kluemper is one of ninety-three remonstrators who filed what is designated by statute as an “appeal” to the Dubois Circuit Court, pursuant to the provisions of §48-702, Burns’ Ind. Stat., 1950 Replacement (Supp.), wherein they resisted and attacked the annexation by written remonstrance. Appellee filed an answer to this, putting the cause at issue.
