Plaintiff, Chairman of the Salt Lake County Planning and Zoning Commission, was indicted by a Grand Jury on two counts of soliciting a bribe and two counts of accepting a bribe; all are felonies. Plaintiff filed a petition for a writ of ha-beas corpus, alleging the illegality of his constructive restraint. The trial court dismissed the action on the ground the complaint failed to state a claim upon which relief could be granted. Plaintiff appeals. We should reverse, in part.
