MEMORANDUM OPINION
ALBRITTON, Chief Judge.
Before the court is Defendant’s Motion For Summary Judgment and supporting brief filed June 18, 1998. Plaintiff filed his response and the deposition of John Dattilo on July 31, 1998. After a careful review of these submissions, relevant precedent and the record as a whole, the court concludes that Defendant’s motion should be granted.
