Pinola, P. J.,

Plaintiff has obtained a rule to show cause why the stenographer should not be required to transcribe the testimony taken in a partial hearing of the above case.

By stipulation of the parties, the sole issue for determination involves the validity of a counterclaim filed by defendant. From June 9th to 11th, the hearing proceeded before Judge Lewis. Defendant called its witnesses, and, except for the offer in evidence of a deposition of a witness and a ruling on defendant’s request for plaintiff’s production of documents, it had con-*462eluded its case at closing on June 11, 1964.…
