Pending before the Court is a Motion to Dismiss Plaintiffs Amended Complaint. Defendant’s, James Peter Sobol (“Sobol”), *485Motion to Dismiss was filed on October 16, 2015 (“Motion”). For the reasons stated below, the Motion is granted in part and denied in part.

1. Jurisdiction

The Court has jurisdiction over this matter pursuant to 28 U.S.C. §§ 157 and 1334. This is a core proceeding under 28 U.S.C. § 157(b)(2)® and (J).
