VAN GRAAFEILAND, Circuit Judge:
Appellant, Local 239 of the International Brotherhood of Teamsters, brought this action in Supreme Court, New York County, to confirm an arbitration award against appellee, Merrick Central Carburetor, Inc. Merrick removed the case to the United States District Court for the Southern District of New York. Both parties then moved for summary judgment. The court (Werker, J.), in a Memorandum Decision and Order dated July 20, 1983, granted Merrick’s motion and vacated the award. Judgment was entered on July 22, 1983, and this appeal followed.
