Mr. Presiding Justice Crabtree

delivered the opinion of the Court.

This was an action on the case by plaintiff in error against defendant in error, to recover damages for the destruction by fire, of 3,476 tons of baled straw, and a straw stacker, which straw was stacked in close proximity to a switch track operated by defendant in error at Loekport in said Will county. It is claimed that the fire which consumed this property was ' communicated from one of defendant in error’s passing engines engaged in hauling cars upon said switch track.
