Appeal in each case by the plaintiff, Julia Morris Curtiss Lawrence, and by the defendant, United States Fidelity and Guaranty Company, from a judgment of the Supreme Court in favor of the respondent, entered in the office of the clerk of the county of New York on the 19th day of August, 1914, upon a decision of the court dismissing the complaint after a trial at the New York Special Term.

These actions were brought to cancel two bonds, one for $12,500, and the other for $17,500, executed by the plaintiff as principal and the United States Fidelity and Guaranty Com*188pany as surety— the former to the defendant Keith W. Morris, and the latter to Hilda 0. E. Morris, children of the plaintiff. Counterclaims were interposed by the respondents for the amounts alleged to be due upon their respective bonds. The actions were tried together and resulted in a dismissal of the complaints and judgments against both appellants in favor of Keith W. Morris for $5,957.20 and Hilda…
