Before the Court are Defendant United States Postal Service’s Motion to Dismiss, or in the Alternative, Motion for Summary Judgment [Tab 11] and Plaintiffs Cross-Motion for Judgment on the Pleadings, or in the alternative, Motion for Summary Judgment [Tab 16]. As both motions involve the same questions of law, they will be analyzed and adjudicated together in this Order.
