Donald R. Ehrhardt (plaintiff) appeals a summary judgment for Ronald J. Her-schend (defendant) in an action for malicious prosecution. This court reverses and remands.

Plaintiff and defendant were candidates for separate county offices in 2004. Defendant sought re-election to the office of Taney County Commissioner for the western district of Taney County.
