In 1977, appellant Gordon Gould applied for a patent on certain laser technology. When the Commissioner of Patents and Trademarks (“PTO”) rejected the application in toto for inadequate disclosure of the claimed invention, appellant sought de novo review in the District Court. The court did not address the merits of the inadequacy of disclosure issue, but instead granted summary judgment for the PTO solely on the ground of collateral estoppel, giving preclu-sive effect to findings of inadequate…
