MEMORANDUM-DECISION AND ORDER

McCURN, District Judge.

Plaintiff, Triad Financial Establishment [“Triad”] brings this breach of contract action against defendant, The Tumpane Company [“Tumco”], seeking more than $3.5 million in commissions allegedly owed to Triad under the contracts between the parties. Presently before the court are cross-motions for summary judgment. For the reasons set forth below Triad’s motion for summary judgment is denied and Tum-co’s motion for summary judgment is denied in part and granted in part.
