This case originated in the circuit court of Ogle county, and is an action on the case, by appellee, against appellant, for negligently causing the death of Arthur B. Slater, his son.
The deceased was about nine years old; When killed he was in a farm wagon, drawn by two horses, with an elder brother, thirteen years of age. The two boys were in charge of the team, and in attempting to cross the track of appellant, on the public highway, using due care, as is alleged in the declaration, the wagon was struck by a passing locomotive and both boys killed.
