This is an appeal by complainant from a decree which, sustaining certain exceptions of defendants to the report of a master, dismissed the bill of complaint for want of equity. The bill was filed June 7, 1930, and averred that defendants, Carl Biemer and Grace Biemer, were husband and wife; that Grace Biemer on February 15, 1930, was the owner of certain real estate described and was engaged in the erection and construction of certain improvements thereon; that Carl Biemer, with the authority, knowledge, permission and consent of his wife, made a contract with one H.
