OPINION

TENNEY, District Judge.

Defendant moves for reargument of a decision of this Court which denied a motion to dismiss the first three causes of action of plaintiffs’ amended complaint, granted a motion to dismiss plaintiffs’ fourth cause of action without prejudice to the institution of an action based upon such claim in the proper court, and reached no decision with respect to plaintiffs’ fifth cause of action for attorney’s fees.
