— Appeal from a judgment of the Supreme Court at Special Term, entered December 28, 1979 in Washington County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to be transferred back to the Great Meadow Correctional Facility until such time as he was afforded a hearing. The facts are undisputed. Petitioner is an inmate in the custody of the New York State Department of Correctional Services.
