The plaintiff received severe bodily injuries in the collapse of a large pile of sawdust at the defendant’s saw mill, and brought this action to recover damages. The verdict and judgment below were in his favor, and the cause is here on the defendant’s exception to the denial of his motion for a directed verdict. The grounds of the motion were that, on the evidence taken in the light most favorable to the plaintiff, (1) the defendant was not guilty of any negligence proximately causing the accident, (2) the plaintiff was guilty of contributory negligence, and (3) the plaintiff assumed the…
