Appellant John Leslie Crary was convicted of violating Penal Code section 211 (and pursuant to Penal Code section 211a the jury fixed the degree as robbery in the first degree) as charged in the information filed by the District Attorney of Stanislaus County which charged appellant and his codefendant, Prank Stanley Pust, Jr., with stealing $2 worth of gasoline by means of force and fear and the use of a deadly weapon.
