MELTON, District Judge.
Plaintiff Gloria E. Kirby, as representative of the estate of Roy Alan Kirby, initiated this wrongful death action in the Circuit Court, Fourth Judicial Circuit, in and for Duval County, Florida. In her complaint, she alleges that Roy Alan Kirby’s fatal injuries were caused by defendant’s negligence and the unseaworthiness of OMI WABASH, a commercial vessel owned and operated by defendant.
