Stephen Hunter, Allan Tanguay and Danny True (appellants) were convicted of mail fraud and conspiracy to defraud the United States in violation of 18 U.S.C. §§ 371, 1341, 1342. They all received sentences below the applicable range of the United States Sentencing Guidelines (Guidelines). In an earlier appeal, we held that the district court improperly applied a three-level upward adjustment computed under the Guidelines and remanded for resentencing. United States v.
