Affirming.

Hiram Halcomb was tbe owner of a twenty-two acre tract of land in Harlan County, and on June 22, 1929, be conveyed ten acres of tbis land to bis wife, Mornain. On June 24, 1929, Halcomb and bis wife executed a mortgage on tbe husband’s land to secure G-, W. Howard and J. Gf. Forester on a $2,000 note wbicb they bad paid as sureties for Halcomb. Suit was instituted by Howard and Forester to foreclose tbis mortgage and plaintiffs also sought to have tbe deed executed by Hal-comb to bis wife set aside as a fraudulent conveyance.
