ORDER GRANTING SUMMARY JUDGMENT FOR DEFENDANT

THIS CAUSE comes before the Court upon the City’s countermotion for summary judgment (doc. 103) and memorandum in support thereof (doc. 104), and Plaintiffs memorandum in opposition (doc. 114). For the reasons set forth below, the Court finds the motion must be denied.
