Plaintiff, the owner of a multi-family apartment complex, filed suit for declaratory judgment against defendant water company, a public utility, to determine a dispute between the parties over billing for water used in the apartment complex. Plaintiff alleged that defendant’s water meters were inaccurate and as a result plaintiff was charged in excess of three times the amount charged for water used in the apartment complex during comparable periods.
