The City of Knoxville in the exercise of its power of eminent domain ■ brought this action *615against Clinton Livestock Auction Company to acquire for highway purposes a triangular tract of land containing 5,142 square feet, fronting 91 feet on Willow Street in Knoxville. As authorized by T.C.A. sec. 23-1526, the condemner paid into court the sum of $6428.00, as the value of the land.

The trial jury fixed the value of the land at $6,000.00, or $428.00 less than the amount paid into court. Accordingly, as provided by the statute, a judgment was rendered against the defendant for that amount.
