This dispute arises from the City of Brooksville’s (the “City”) attempt to recover $5.3 million from Westchester Fire Insurance Company (“Westchester”) ostensibly to install infrastructure for an abandoned, single-family housing development in Brooksville, Florida. Pursuant to 28 U.S.C. § 2201, Westchester seeks a declaration of the parties’ rights and obligations under two performance bonds that require Westchester to indemnify the City from damage arising from a developer’s failing to build infrastructure for the abandoned development.
