Ebroe to review a judgment of the circuit court for Chippewa county: A. J. ViNJE, Circuit Judge. Plaintiff in error was duly convicted of the crime of assault with intent to murder. Exceptions were saved requisite to present for review the questions discussed in the opinion. The facts are there indicated, so far as necessary to an understanding of such questions.

The charge was that the accused, upon a particular day and at a particular place named, while armed with a deadly weapon, to wit, a rifle, feloniously assaulted five persons, named, with intent to murder them.
The general claim of the state was this: John Dietz resided on the banks of the Thomapple river in Sawyer county, Wisconsin, some sixty miles by the nearest usable traveled way from the railroad station at Hayward, the county seat, and in a wild and substantially uninhabited country; miles beyond *155the termini of public highways, and reached only by traveling through forests on rough…
