—In an action to recover damages for personal injuries and wrongful death, the defendant appeals from (1) an order of the Supreme Court, Suffolk County (Gowan, J.), dated May 1, 1997, which granted the plaintiff’s motion to preclude the defendant from offering any evidence at *372trial in support of its defense, and (2) an order of the same court dated August 8, 1997, which, inter alia, granted the plaintiffs motion for summary judgment in its favor on the issue of liability.
