— In an action to recover damages for personal injuries, etc., the defendant City of New York appeals from (1) an order of the Supreme Court, Kings County (Greenstein, J.), entered June 5, 1989, which granted the motion of the defendant third-party plaintiff L.K. Comstock & Co., Inc., to strike its answer to the cross claim asserted pursuant to CPLR 3126 by L.K.
