Appellant, who was charged by affidavit with the unlawful transportation of intoxicating liquors in an automobile under §7, ch. 48, Acts 1925, §2720 Burns 1926, tried by the court, found guilty, fined $100 and costs and sentenced to imprisonment in the Indiana State Prison, assigns as error the overruling of his motion for a new trial in which he contended that the finding of the court was not sustained by sufficient evidence.
