Tbe court below, in this action brought by a beneficiary in a policy of insurance issued on tbe life of ber husband by the appellee, gave binding instructions to the jury to render a verdict in favor of the plaintiff in the sum of $14.44 which was the amount of the premium paid by the insured plus accrued interest. The motion for a new trial which followed was dismissed and judgment entered on the verdict.
