This is an action of contract, whereby the conservators of the estate of John P. Donahue and the administrator of the estate of Nicki A. Donahue seek to recover a deposit made pursuant to a written agreement for the purchase of land and building of a house thereon, to be constructed by the defendant.

*129The answer was a general denial and an assertion that the defendant performed his part of the agreement.
