In this criminal appeal, the Government challenges the district court’s downward departure from the otherwise applicable statutory mandatory minimum sentence of 10 years’ imprisonment, arguing that no recognized exception to the statutory minimum applies in this case. Bobby Phillips, Jr., cross-appeals the district court’s denial of his motion to suppress evidence of crack cocaine and other items seized from a backyard storage shed located on property belonging to another individual.
