In this appeal we consider whether the safety valve provision of 18 U.S.C. § 3553(f) applies to defendants convicted of possession with intent to distribute cocaine on board a vessel, in violation of the Maritime Drug Law Enforcement Act, § 3, 46 App. U.S.C. § 1903 (repealed 2006).1 We hold that the safety valve is unavailable to defendants convicted under 46 App. U.S.C. § 1903.2 Therefore, we vacate the sentences of Carlos Hernando Gamboa-Cardenas, Jaimen Barahona-Es-tupinan and Edgar Cuero-Aragon, and we remand for resentencing without the safety valve.…
