This is an action of tort to recover upon a declaration in two counts, one for the death (G. L. [Ter. Ed.] c. 229, § 5), and the other for the conscious suffering of the plaintiff’s intestate, hereinafter referred to as Fulton, alleged to have been caused by the defendant’s negligence. The answer is a general denial, that the intestate was contributorily negligent and that he voluntarily assumed the risk.
