This appeal requires us to determine which tribunal—the Hawaii Labor Relations Board (HLRB) or the circuit court—had jurisdiction to resolve a labor dispute regarding the selection of a neutral arbitrator.
The dispute arose out of a negotiation between the State of Hawaii and other governmental entities (collectively, “the State”) and United Public Workers (UPW) to renew and modify a collective bargaining agreement (CBA).
