In July, 1920, Andrew Dipple, who then was the owner of lands in Toole county, executed an oil and gas lease for a term of years to Gordon Campbell. Eventually this lease was assigned to the plaintiff. Prior to giving the lease Dipple had executed several mortgages upon the land, two to Mohall State Bank and a third to Hart-Parr Company. The Mohall State Bank foreclosed its second mortgage but did not make plaintiff, then owner of the Campbell lease, a party to the action.
