THOMAS, Circuit Judge.

Richard Gregg was tried, convicted and sentenced in the court below on two counts of an information charging violations of the federal liquor laws, and he appeals.

Count 1 of the information charged an unlawful attempt to import, bring and transport intoxicating liquor into the state of Kansas, a state qualified by its laws for protection under the Twenty-first Amendment to the Constitution of the United States, in violation of 27 U.S.C.A. § 223.
