Appeal from Jackson Criminal Court. — Hon. John W. Wo ford, Judge. (1) The court should have sustained defendant’s demurrer to the information, and motion to quash. The information charges that the defendant did falsely, etc., pretend and say certain things alleged therein— “by virtue of the premises, to-wit:” and then specially sets forth the specific pretenses, which it does not allege were designedly, feloniously and falsely made.

On the 27th day of February, 1905, the prosecuting attorney of Jackson county filed an information in the criminal court of said county, at Kansas City, charging the defendant and one James B. Turner and one W. S. Gibbs with obtaining certain household goods and furniture from one S. L. Tolly, by false pretenses.
