Affirming.
Tim Philpot, the appellant, was jointly indicted with his brother, Ed Philpot, Joe Stewart, and Arthur Jackson for the murder of Sam Parmer in Bell county early in January, 1928. They demanded separate trials, and the commonwealth elected to try the appellant. He was convicted and Ms punishment'fixed at life imprisonment.
