Appeal, No. 299, Oct. T., 1918, by libelant from decree of C. P. No. 5, Philadelphia Co., June T., 1917, No. 563, dismissing libel in divorce in case of George L. Magee v. Josephine Magee. Libel in divorce. The facts are stated in the opinion of the Superior Court. Error assigned was decree dismissing the libel.

The appellant filed a libel for a divorce for wilful and malicious desertion. Testimony was taken in support of the action, and in opposition thereto. The master after a review of the evidence recommended that the libel be dismissed. The court approved the recommendation and entered the decree from which this appeal was taken. The parties were'living in a rented house in Philadelphia at the time the desertion is alleged to have taken place. They had three children.
