FISHER, Circuit Judge:

California state prisoner Ivan Curtis Charles appeals the district court’s denial of his § 2254 petition. 1 Charles is currently serving a life sentence without the possibility of parole after being convicted in 1988 of first-degree murder with special circumstances for shooting Gerald Darnell Mitchell in retaliation for his testimony against Charles in a 1980 robbery trial.
