This is an appeal from the judgment of the Circuit Court of Kanawha County which dismissed the appellant’s action to construe a will. The appellant, The Woman’s Club of St. Albans, sought a judicial determination of whether property devised to the Club by the will could be sold or used commercially without losing the real estate.
