The factual background of the above motions will be briefly stated.
The plaintiff is the owner of property consisting of a small island located in the St. Lawrence River in the vicinity of Alexandria Bay, N. Y.
Defendant Tecon Corporation is a Delaware corporation with its place of business at New York City. It entered into a contract with St. Lawrence Seaway Development Corporation for the performance of certain work, labor and services in connection with the widening and deepening of the St. Lawrence River.
