This writ brings up for review a judgment of the Hudson Circuit Court. It was based upon the alleged negligence of the motorman of one of the defendant’s cars, on which the plaintiff was riding towards his home, in Jersey City, on the night of January 26th, 1900. The plaintiff was a violinist, twenty-two years of age. He took a Newark avenue car at Exchange Place which ran toward the court house, and was to leave the car at Brunswick street.
