The complainant, Frank Fischer Merchandising Corp., is a wholesaler-distributor of products bearing the trade-marks, brands or names of manufacturers or producers. It filed a bill of complaint charging violations by the defendant of R.S. 56:4-3 etseq., commonly known as the "Fair Trade act," and the contracts and price schedules established thereunder for certain of the products distributed by the complainant. The present application is for a preliminary injunction. The facts are undisputed and the issues are resolved into pure questions of law.
